Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and DressUp ("DressUp", "we", "us") governing your use of the DressUp mobile app and related services (the "Service"). Please read them carefully. By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility & age

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service, and old enough to form a binding contract. If you are under the age of majority, you may use the Service only with the involvement of a parent or guardian.

2. Your account

You are responsible for the activity under your account and for keeping your access credentials secure. Provide accurate information and notify us of any unauthorised use. We may suspend or terminate accounts that violate these Terms.

3. Licence to use the Service

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own personal, non-commercial use. You may not copy, modify, reverse-engineer, resell, or create derivative works of the Service except as permitted by law.

4. Your content

"Your Content" means the photos (including photos of your clothing and, if you choose, of yourself), text, preferences, and other materials you submit. You retain all ownership of Your Content.

You grant us a limited, worldwide, royalty-free licence to host, store, process, reproduce, and modify Your Content solely to operate and provide the Service to you — for example, to remove backgrounds, tag items, and generate your avatar and outfit visualisations. This licence exists only to run the Service for you and ends when you delete the content or your account, except for backups retained briefly in the ordinary course or records we must keep by law. We do not use Your Content to train our own AI models, and we do not use it for advertising. You represent that you have the rights to submit Your Content and that it does not infringe anyone's rights.

5. AI-generated content

The Service uses artificial intelligence to generate avatars, item tags, styling suggestions, and outfit visualisations ("Outputs"). Outputs are produced automatically, may be inaccurate or imperfect, and are provided for your personal use. Avatars and visualisations are stylised depictions and may not exactly represent you or how a garment will actually look or fit. You should use your own judgement and not rely on Outputs as professional advice.

6. Acceptable use

You agree not to:

• Upload content you do not have the right to use, or that is unlawful, infringing, or violates another person's privacy or likeness rights.
• Upload photos of other people without their consent, or attempt to use the Service to identify or impersonate anyone.
• Interfere with, disrupt, or attempt to gain unauthorised access to the Service or its systems.
• Use the Service to build a competing product, or scrape or extract data at scale.
• Misuse AI features to create misleading, harmful, or deceptive content about real people.

7. Subscriptions & billing

Some features require a paid subscription. Subscriptions are sold through the Apple App Store and billed to your Apple ID. Prices and features are shown in the app before purchase.

• Auto-renewal. Subscriptions renew automatically for the same period unless cancelled at least 24 hours before the end of the current period.
• Manage or cancel. You can manage or cancel anytime in your Apple ID subscription settings. Cancelling stops future renewals; it does not retroactively refund the current period.
• Free trials. If offered, any unused portion of a free trial is forfeited when you purchase a subscription.
• Refunds. Purchases are handled by Apple and are subject to Apple's refund policies; we do not process App Store payments or refunds directly.

8. Intellectual property

The Service, including its software, design, branding, and content (excluding Your Content), is owned by DressUp or its licensors and protected by intellectual-property laws. These Terms grant you no rights in our trademarks or branding.

9. Third-party services

The Service relies on third-party providers (including those listed in our Privacy Policy). We are not responsible for third-party services, and your use of them may be subject to their own terms.

10. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that Outputs will meet your expectations. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.

11. Limitation of liability

To the maximum extent permitted by law, DressUp and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 50. Nothing in these Terms limits liability that cannot be limited by law.

12. Indemnification

You agree to indemnify and hold DressUp harmless from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your violation of these Terms or the rights of others.

13. Termination

You may stop using the Service and delete your account at any time from within the app. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or other users. Sections that by their nature should survive termination (such as content licences you granted for already-processed data, intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the jurisdiction in which DressUp is established, excluding its conflict-of-laws rules, unless mandatory local consumer-protection laws in your country of residence apply. You agree to first try to resolve any dispute with us informally by contacting us.

15. Apple App Store additional terms

These Terms are between you and DressUp only, not with Apple, and Apple is not responsible for the Service or its content. Your licence to use the app is limited to a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. Apple has no obligation to provide support or maintenance for the app. To the extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims relating to the app that arise from failure to conform to a warranty are governed by these Terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

16. Changes to the Service and Terms

We may modify the Service or these Terms. If we make material changes, we will update the "Last updated" date and provide notice in the app. Continued use after changes take effect means you accept the updated Terms.
